Chapter 1: Purpose and acceptance

1.1 Purpose

These Terms and Conditions (“Terms”) govern your access to and use of the Selv-a Service.

1.2 Scope

The Service may be offered globally. Mandatory consumer protection laws and local legal requirements may apply depending on where you live.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Chapter 2: Definitions

Service: the Selv-a app, any associated websites, AI features, and related services.

User Content: content you submit, including prompts, journal entries, and voice inputs.

Outputs: AI-generated or system-generated responses, insights, or suggestions.

Third-Party Services: AI Providers, app stores, login providers, analytics vendors, and other vendors used to provide or support the Service.

Chapter 3: Eligibility and account registration

3.1 Age eligibility

You must be at least 16 years old to use the Service.

3.2 Account information and security

You must provide accurate information and maintain the security of your account. You are responsible for all activity on your account and for safeguarding your credentials.

Chapter 4: Service description and tiers

4.1 Service description

Selv-a is a freemium Service. Some features may require payment.

4.2 Changes to the Service

We may change features, introduce new tiers, remove features, or modify limits, including to improve quality, safety, or performance.

4.3 Testing and experiments

We may run tests and experiments (including A/B tests), including switching the AI Provider used for a given feature, to improve quality and performance.

4.4 Your responsibility for reliance

You are responsible for verifying that the Service meets your needs before relying on it for any purpose.

Chapter 5: AI nature of the Service and transparency

The Service uses AI and automated systems to generate Outputs. Outputs may be generated without human review. We may inform you that you are interacting with an AI system and that Outputs may be AI-generated where required or appropriate.

Chapter 6: No professional advice

The Service and Outputs are for wellbeing and self-discovery purposes only. They are not medical, psychological, legal, or financial advice and do not create a professional-client relationship. You must seek qualified professional advice for professional matters.

Chapter 7: High-stakes prohibition and required human review

7.1 Prohibited high-stakes uses

You must not use the Service or Outputs to make or support decisions in high-stakes contexts, including:

  • employment, worker management, or hiring decisions
  • credit, banking, insurance, or financial eligibility decisions
  • education admissions, grading, or evaluation decisions
  • legal status, immigration, law enforcement, or similar decisions
  • medical diagnosis, treatment, crisis intervention, or clinical decision-making.

You must not use the Service in any way that could materially affect a person’s rights, opportunities, or access to essential services.

7.2 Responsibility

You are responsible for assessing whether your use case is high-stakes and for not using the Service where prohibited.

Chapter 8: Acceptable use and prohibited content

You must not:

  • violate laws or third-party rights
  • submit content that is illegal, abusive, exploitative, or intended to harm others
  • attempt to bypass safety controls
  • reverse engineer, scrape, or extract the Service at scale
  • use Outputs to impersonate people or misrepresent AI-generated content as human-generated in a deceptive way.

You are responsible for your User Content and your use of Outputs.

Chapter 9: Third-party AI Provider rules

Because the Service may route requests to different AI Providers, you agree not to use the Service in ways that violate applicable third-party provider rules (including content restrictions and safety rules) that apply to the features you use. We may enforce these restrictions through moderation and account actions.

Chapter 10: User Content, ownership, and licenses

10.1 Ownership

You retain ownership of your User Content, subject to any rights of third parties.

10.2 License to Selv-a

You grant Selv-a a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and create derivative works from your User Content solely to:

  • provide the Service
  • generate Outputs
  • perform safety checks and enforce integrity rules
  • improve the Service (including evaluation and QA)
  • comply with legal obligations and defend legal claims.

10.3 Sublicense to vendors and AI Providers

You grant Selv-a the right to sublicense the license in Section 10.2 to Processors and AI Providers only as necessary to provide and support the Service.

10.4 Third-party training (may train)

You acknowledge that, depending on the AI Provider and configuration, User Content and Outputs may be used to improve third-party models under their terms, and you accept this as part of using those features.

Chapter 11: Sharing features, pools, and your responsibility

If you share Outputs or create pools, you are responsible for what you share and with whom. Do not share Personal Data about other people without their permission. Shared links may be accessible to anyone with the link unless the Service provides access controls. Do not use sharing features to disclose sensitive or confidential information unless you accept the risks of disclosure.

Chapter 12: Advertising and partner placements

Selv-a may display ads and partner placements within the app. Targeting is first-party within Selv-a. We do not provide advertisers with identifiers for cross-site or cross-app tracking. Partners may learn information about you only if you click through and interact with their services, which are governed by their own terms and privacy policies.

Chapter 13: Safety and crisis disclaimer

Selv-a is not an emergency service or a suicide prevention hotline. The Service may provide crisis resources or encourage contacting emergency services or qualified professionals if it detects concerning signals, but:

  • we do not guarantee detection
  • we do not guarantee intervention
  • you must seek immediate help if there is imminent danger.

Chapter 14: Subscriptions, payments, renewals, and refunds

Paid features may be billed via Apple App Store, Google Play, or other processors. Renewal, cancellation, and refunds are governed by the platform’s terms and any mandatory consumer rights. We may change pricing with notice where required. Taxes may apply depending on your location and the platform’s rules.

Chapter 15: Intellectual property

Selv-a and its licensors own the Service, software, interfaces, branding, and related intellectual property, except User Content. You receive a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own lawful, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, rent, lease, or create derivative works from the Service except as allowed by law.

Chapter 16: Service availability, changes, and termination

16.1 Availability

The Service is provided “as is” and “as available”.

16.2 Changes and discontinuation

We may modify, suspend, or discontinue features at any time, including for safety, security, or maintenance reasons.

16.3 Suspension and termination

We may suspend or terminate access if you violate these Terms, misuse the Service, or create security risk. Where reasonable, we may provide notice, but we may act immediately where needed to protect users, the Service, or third parties.

16.4 Export and backups

You are responsible for exporting content you need and maintaining backups where appropriate.

Chapter 17: Disclaimers

To the maximum extent permitted by law:

  • we make no warranties regarding accuracy, completeness, reliability, or fitness for a particular purpose
  • Outputs may be incorrect, outdated, incomplete, or misleading
  • you use the Service and Outputs at your own risk.

Nothing in these Terms limits mandatory consumer guarantees that cannot be excluded under applicable law.

Chapter 18: Limitation of liability

18.1 General limitation

To the maximum extent permitted by law, Selv-a is not liable for indirect, incidental, consequential, special, or punitive damages, or for decisions you make based on Outputs.

18.2 Liability exclusions that cannot apply

Nothing in these Terms excludes or limits liability to the extent it cannot be excluded under applicable law, including liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • willful misconduct or gross negligence, where such limitations are prohibited.

18.3 Liability cap (for non-consumer claims and where permitted)

Where permitted by law, Selv-a’s aggregate liability is capped at the greater of:

  • the amounts you paid us in the 12 months prior to the event giving rise to the claim, or

EUR 50, except where liability cannot be limited under applicable law.

For consumers, this section applies only to the extent permitted by mandatory consumer protection rules.

Chapter 19: Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold Selv-a harmless from claims arising out of:

  • your User Content
  • your misuse of the Service
  • your violation of these Terms or applicable law
  • your infringement of third-party rights.

This indemnity does not apply where prohibited by mandatory consumer law.

Chapter 20: Dispute resolution and governing law

20.1 Governing law

Italian law applies, without prejudice to mandatory consumer protections in your country of residence.

20.2 Informal resolution

Before filing a claim, contact Support (TBD) and attempt informal resolution.

20.3 Venue and jurisdiction

If you are a consumer resident in Italy, disputes will be subject to the mandatory territorial jurisdiction of the court of your residence or domicile in Italy, where applicable.

If you are not a consumer, venue will be Milan, Italy, unless otherwise required by mandatory law.

Chapter 21: Changes to Terms

We may update these Terms from time to time. If changes are material, we will notify you via email or in-app notice where required. Continued use after the effective date may constitute acceptance where permitted by law.
